Gift Card Terms & Conditions

1. The Gift Card (hereinafter, the “Card” or the “Cards”) is the property of the entity that issues it, New Martina Srl, with registered office in Naples, Centro Direzionale Isola G/1 CAP 80143, CF/PIVA 07151561219, N. REA NA-864987. The holder of the Card is considered a mere custodian of the same.
2. The Card is valid exclusively in Italy for the purchase of items offered for sale at the point of sale or on the website bearing the name and name: New Martina (www.newmartina.it) hereinafter, individually, ''Point of Sale''.
3. The Card can be purchased using the payment methods accepted at the Points of Sale. The Card cannot be purchased using another Gift Card.
4. The Card that has not been used can be returned exclusively to the Point of Sale where it was purchased under the following terms and conditions:

4.1 Physical Cards purchased online can be returned within 30 days from the date of the shipping confirmation email.

4.2 Virtual Cards can be returned within 30 days from: o the date of delivery to the indicated recipient, if you select the method of sending via email by New Martina o the date of purchase of the Card if you wish to share it personally. The purchase price of the Card can be refunded using the same payment methods used to purchase it. For the refund it will be necessary to produce the document proving the purchase of the Card in original or the E-ticket and, where necessary, the credit or debit card with which the payment was made and the relative receipt. The return of Gift Cards purchased in other countries or on websites of other countries will not be accepted. The sale of the aforementioned types of Cards is subject to their availability in Italy.

5. The Card can be used in multiple solutions up to the initial value indicated. The Card has a maximum value of Euro 300.00.
6. The residual value of the Card will appear from time to time on the receipt issued at the time of purchase of the items using the Card in the Points of Sale or in the information provided at the time of order confirmation for purchases made online. The residual value of the Card can be checked at the Point of Sale. If the purchase price of the desired items is higher than the residual value of the Card, the difference must be paid using the payment methods accepted at the Point of Sale.
7. Items purchased using the Card at the Point of Sale will be subject to the same general terms and conditions of sale valid for any other item purchased at the Point of Sale, and to the provisions of the following article 8.

8 Where applicable, refunds for items purchased using the Card and returned will be made as follows:

8.1 by increasing the residual value of the Card, provided that such Card still exists at the time of return;

8.2 through a Voucher, when the Card no longer exists at the time of return, issued by New Martina, which will be (i) delivered to a point of sale for the return of products purchased in a store or (ii) sent by email to the address indicated by the customer who made the purchase using the Card, for the return of products purchased online. The voucher will be subject to these general conditions of use, as applicable. The return terms indicated are to be considered essential and, as such, are expressly accepted at the time of purchase and/or use of the Card.

9. The Cards have the following duration: • Physical Cards are valid for 2 years from the date of purchase if purchased at the physical Point of Sale, and from the date of the shipping confirmation email if purchased at the online Points of Sale • Virtual Cards are valid for 2 years from the date of delivery to the indicated recipient, if you select the sending method via email by New Martina, and from the date of purchase of the Card if you instead wish to share it personally. Upon expiration of the validity, the Card cannot be renewed or used to purchase items and the residual value of the Card cannot be refunded or converted into cash.
10. The Card is not nominative and can be used by anyone who presents it to purchase items. The Card holder is solely responsible for the use and custody of the Card. In the event of theft, loss or damage, the Card will not be replaced. In any case, New Martina may replace the Card in the event of a change in the format of the Card itself.
11. For purchased Virtual Cards, New Martina will not be responsible for the failure to receive or delay in receiving said Virtual Card by the recipient due to causes of force majeure and in any case not attributable in any way and to the maximum extent permitted by current legislation to New Martina such as, by way of example and not limited to: (i) poor functioning or interruption of telecommunication lines and/or systems, (ii) delay in the transmission of information or data or the loss of information or data that may occur for one of the causes indicated in the previous point (i), (iii) the inaccuracy of the data of the recipient of the Virtual Card provided by the purchaser of the Card itself, (iv) the circumstance that the email sent by New Martina is considered spam or junk mail.
12. Cards obtained by any fraudulent or illegal means will be considered null and void, cannot be used to purchase items and the purchase price cannot be refunded.
13. The Card may not be used for advertising purposes or to promote products or services marketed by third parties other than the entity issuing the Card, unless previously authorised by the latter.
14. The purchase and/or use of the Card entails full acceptance of these general conditions, which were made available to the customer at the time of purchase of the Card and available at the Points of Sale.
15. The Card merely allows a payment method and is not intended in any way as an investment tool and/or a solicitation to save.
